This privacy policy details Givetastic’s policies and procedures for collecting, storing, transferring and sharing your personal data. The below statement describes how we collect and protect your personal information from being shared with any unauthorised third parties.

Within this privacy policy, Givetastic also explores your privacy rights and how the law is duty bound to protect you.

As a whole we use your personal data to improve and update our services. By using Givetastic, the service, you agree to the collection and use of your personal data in accordance with the below privacy policy.

The below policy covers our site givetastic.com or “Givestastic”, plus any additional online areas, sites or services that we own. “Givetastic” may be referred to as “we”, “us,” or “our” throughout the proceeding privacy policy.

1.2 Policy and Personal Changes

We regularly review our privacy policy to ensure all information is accurate and up to date with current GDPR standards. The date of the most recent updates or changes to this policy can be seen at the top of this page.

Equally, it is also your responsibility as a user to keep us informed of any changes to your personal data. This is to ensure that any data collected during the course of your relationship with us is current and accurate.

1.3 Third Party Links

Our site may contain links or third party plug-ins that help us function and operate efficiently. If you, the user, are to click on any such link you may allow such third parties to collect information about you.

Givetastic has no control over these third party websites, and as such we recommend that you familiarise yourself with the privacy statements of any external website that you visit.

2. Types of Data Collected

2.1 Personal Data

Whilst using the Givetastic service we may request to, and collect personal information about you, to help us identify or contact you.

For ease we have categorised the personal information we collect into categories:

  • Identification Data: First name, Last name and Username.
  • Profile Data: Username, Password, Collection Details, and Order History.
  • Contact Data: Email address
  • Financial Data: Card payment details
  • Transaction Data: Recipient information (information of the person you wish us to deliver the collection to)
  • Technical Data: Login data, browser type (Chrome, Safari, Microsoft Edge etc), browser plug-ins (i.e AdBlock), device type, time zone settings, location, and Internet Protocol (IP) address.
  • Usage Data: Information about how you use, navigate and share our site, products and services.
  • Marketing and Communications Data

2.2 Failing to Provide Data

If you fail to provide us with the necessary personal information (name, email address and payment details), we may not be able to provide you with the goods or services that you are seeking. In this instance, we will have to terminate the transaction process, but will notify you of this at the time.

2.3 Card payments and online transactions

If you choose to purchase any of our products (gift cards or flowers) or when you contribute to a collection, your card details will not be recorded or stored within our system. Whenever you are required to provide card details, this will be done through a secure payment page which will be hosted by our authenticated payment processor.

You do not need to provide any card details if you are only signing a message on a collection.

How Givetastic collects your data

Givetastic collects your personal data when you access our site givetastic.com, sign up to our services, contact us via support@givetastic.com, leave us feedback, purchase our products, contribute to a collection, sign a message on a collection and sign up for email marketing or newsletters.

We collect your personal data using the following methods:

a. Direct collection:

We collect your information directly when you provide us with identity and contact information, specifically when you sign up to use our services or contact us via email. This includes the personal data you provide when:

  • You create an account and sign up to use Givetastic;
  • Opt-in to receive updates, reminders and marketing via email;
  • Give us feedback;
  • Contact us via support@givetastic.com or services@givetastic.com

b. Automated Collection:

As you, the user, use and navigate our site we automatically gather and collect technical data about your devices, user patterns and browsing actions. This data is collected via cookies and other similar data collection technologies.

4. How Givetastic uses your personal data

Givetastic only uses your personal data where the rules and regulations of the Data Protection Act 2018 allow us to do so. Below we have explained some of the most common instances where we would use the personal data that we collect:

  1. To complete our service - We cannot complete the Givetastic service without the provision of personal data such as your name and email address. Where this has been provided, Givetastic will use it to carry out and complete our collection services. To maintain our service - As explained above, the personal data collected on usage and navigation allows us to monitor customer behaviour in order to maintain and improve our service.
  2. To carry out our contract - If you wish to purchase a gift card or flowers at the end of your collection, we have a contractual obligation to carry out the order and complete the purchase. We will use your personal data such as card details, name and email address to do so.
  3. To manage your account - Any usernames and passwords you use when you create a collection with us are automatically stored and used for the management of your account i.e. resetting forgotten passwords, terminating a collection that breaches our Terms and Conditions, or deleting your account once a collection is completed and delivered.
  4. To contact you - Where you provide Givetastic with contact details (email address only) we may use this information to contact you regarding updates about your collection and/or account, and/or our products and services.
  5. To manage your requests - If you contact us with a query in regards to your account or collection, we will use your personal information provided to help you. For marketing purposes - If you opt-in to receive marketing updates from us via email, we will use the personal information provided to contact you regarding this. This may include newsletters, updates, deals and service announcements.
  6. For business purposes - In the instance that Givetastic is absorbed or merged with another company, the data we collect will be transferred over to or combined with the new business information.
  7. For other purposes - Givetastic may use your personal information for other purposes such as data analysis, user trends and activity, evaluating site performance and creation of marketing campaigns.

Givetastic may also share your personal data, again in compliance with the Data Protection Act 2018, to the following people or for the following purposes:

  1. With our authorised service providers - We may share your personal data with our service providers, such as our payment processor, to assess the functionality of the service. Additionally, your data may be used to allow us to advertise our services on third party websites.
  2. During the course of a business transfer - In the instance of a sale, acquisition or merger of some/majority/all of Givetastics business assets, your personal information may be transferred or shared with the acquiring company or related third parties.
  3. With authorised business partners - The personal data collected may be shared with any of our business partners in regards to our products or services.
  4. With law enforcement - In certain circumstances Givetastic will be required to share your personal data with law enforcement in response to reasonable requests from public authorities. Such circumstances may include (but are not limited to) compliance with legal obligations, prevention of legal wrongdoings, protection of the owners and users of Givetastic and/or protection against any legal liability.
  5. With other users - When you create and share a collection, other users who sign up to use Givetastic and contribute to a collection either with money or a message will also be able to see personal data such as your name and email address.

The above activities are only exercised in the instance that you, the customer or service user, provide us with clear consent to do so.

5. Personal Data Retention

In relation to the above collection and use scenarios, Givetastic will only retain your personal data for as long as reasonably necessary.

Your personal data will be retained within our records in accordance with the Data Protection Act 2018. Your data is only retained in order for us to remain compliant with current laws and regulations, and to carry out business activities such as tax and accounting records.

Oftentimes, your personal data may be retained for longer periods in the instance of resolving legal disputes and/or settling official complaints.

Personal data in relation to usage and navigation will be retained, but for a shorter period of time to help improve our service. However, in relation to site security and functionality, some usage data may be retained for longer.

In some circumstances, you can exercise your legal right to request that your personal data be deleted from our system. You can read more about your legal rights in relation to personal data in Section 6.

6. Personal Data Security

Appropriate and rigid security measures have been implemented across our site and alongside our service providers. This ensures that any personal data you provide to us, or that we collect from you is protected from being accessed, lost or used any unauthorised way.

Internally, in addition to this, Givetastic limits any access to your personal data from employees, contractors, agents and/or any third parties. They will only access and/or process your personal data on a need-to-know basis under strict confidentiality agreements.

7. Your Data Protection Rights

Givetastic respects your privacy and recognises your right to withdraw, request or query your personal data held by us at any time.

You can exercise your legal rights at any time. Under the privacy policy we have outlined, if you are located within the UK you have the right to:

  1. Be informed about how we use and store your personal data: Just as we have outlined throughout this privacy policy, you are entitled to know and request information on how we store and use your personal data.
  2. Access your personal data: You can access your personal data at any time with Givetastic, where you can update or delete your details. If you have trouble accessing your personal data or believe something is wrong, contact us via support@givetastic.com.
  3. Request personal data to be updated: If the personal data we store about you is wrong or has changed, you can request that we update so that it is corrected and accurate, or delete this for you.
  4. Request personal data be deleted: You can request that any or all of your personal data be deleted from Givetastic, when there is no reasonable justification for us to continue processing or storing it.
  5. Request personal data to be transferred: As a user you can request that your personal data be transferred over to a third party site. Where applicable, we will transfer your data over to a machine readable, structured format. Note, you only have the right to access data that you initially granted us permission to collect or use.
  6. Object to your data being collected or used: You have the right to object consent or withdraw previous consent to your personal data being collected, used and stored. If you withdraw consent, accessing certain functions of Givetastic may not be possible.

You may exercise any of the above rights of access, update, erasure and withdrawal of your personal data at any time, free of charge by contacting us via support@givetastic.com. We will ask you to verify your identity upon making such a request. Givetastic will aim to respond to all requests within a timely manner.

In line with the Data Protection Act 2018, each element of this privacy policy has been created in line with the data protection principles.

7. How to complain

As a Givetastic user you have the right to complain to a Data Protection Authority about our collection, use and storage of your personal data.

You have the right to make an official complaint at any given time to the Information Commissioner’s Office (ICO), the UK supervisory authority for data protection issues (www.ico.org.uk). However, Givetastic would appreciate the opportunity to resolve the issue internally before you approach the ICO.

8. Children’s Privacy

Givetastic does not knowingly collect personal information from anyone under the age of eighteen years old. If you are a parent or guardian and are aware that your child has provided us with personal data, please contact us via support@givetastic.com.

If we become aware that a child has knowingly or unknowingly provided us with personal data, we will take the necessary steps to remove any such information from our database.
